Pat Cross is the chair of Baker & Daniels’ health and life sciences practice group and co-chair of the firm’s Health Care Reform Task Force. Pat assists the firm’s health and life sciences clients with developing and implementing strategies to comply with various aspects of the new health care reform law. He helps clients stay on top of the latest proposals for implementing regulatory reform. He advises the firm’s life sciences, health care and technology clients on corporate matters, including mergers, acquisitions and joint ventures, and regulatory compliance strategies, including antitrust, Anti-Kickback Statute, Stark Act, Medicare/Medicaid, HIPAA and HITECH compliance. Pat combines his experience in structuring and negotiating complex corporate transactions with his knowledge of the complicated regulatory environment in which health and life sciences companies operate to provide solid, practical advice to emerging and established companies. Ed Dougherty is B&D Consulting’s health and life sciences practice group leader. Ed consults clients on the short and long short term business impacts, opportunities and challenges presented by health care reform. He assists medical device, pharmaceutical, diagnostics and biotech companies in developing and implementing strategies to support successful commercialization of novel technologies and repositioning of mature products in the U.S. health care market. Libby Baney is an Advisor with B&D Consulting. She counsels clients on a variety of health care reform (PPACA) issues and regularly interacts with the federal agencies implementing health care reform. Libby works closely with Congress, FDA, CDC, NIH, CMS and related associations on issues involving patient safety, clinical research, translational science and public health. Libby provides strategic counsel and analysis on provisions involving pharmaceutical and medical device manufacturers, the 340B drug discount program, high risk pools, and other insurance reforms under the PPACA. She also counsels clients on the new Office of Consumer Information and Insurance Oversight’s development and activities, and assists in preparing formal comments in response to Federal Register notices relating to health care reform. Jennifer Nieto Carey

Jennifer Nieto Carey is a health and life sciences professional, with a particular focus on federal public health policy. She provides strategic counsel to patient advocacy organizations, medical technology companies and health care provider clients on a range of federal administrative and legislative matters. Jennifer was deeply involved in the development of the Patient Protection and Affordable Care Act (PPACA) on behalf of her consumer, information technology and provider clients and worked on their behalf to shape several provisions of the bill related to care coordination and transitions, specialty care shortages, disease prevention and wellness strategies, and comparative effectiveness research. Jennifer is now working with federal agencies and Congress to implement and improve the law so that it meets her clients’ needs. In particular, she is assisting industry and consumer groups to impact implementation of the new FDA approval pathway for biosimilars (or “follow-on biologics”) authorized under PPACA. Lee Tumminello concentrates her practice in life sciences. She advises the firm’s life sciences clients on a variety of issues, including commercial, regulatory and compliance matters related to the clinical development and marketing of pharmaceuticals, biologics and medical devices as well as general corporate and commercial matters. With regard to health care reform, Lee assists pharmaceutical and medical device companies in interpreting and preparing to implement the Physician Payment Sunshine Act, a federal requirement which requires drug and device manufacturers to make annual federal disclosures of their financial relationships with health care professionals (HCPs). Lee and her colleagues have developed policies and training to assist companies in complying with the laws of several states that contain similar disclosure requirements. In addition, Lee counsels pharmaceutical and medical device companies in understanding how they may use data and findings from comparative effectiveness studies to assist in product research and development and possibly in promotion of their products. Dave Zook is an advisor to the private and public sectors on federal budgetary, legislative, and regulatory matters. Dave was deeply involved in the health care reform legislation on behalf of clients in the provider, research, payer, IT, and consumer components of the sector. He worked on over a dozen provisions in the bill spanning diverse issues such as care coordination and transitions, medical loss ratio, specialty care shortages, dental benefits, disease prevention and wellness strategies, and comparative effectiveness research.
